reply to previous corrispondance from Brian Donohoe MP central ayrshire regarding war crimes & duty of care & responsability
Mr Donohoe,
Once again thank you for your speedy response to my last communication regrading chemical weapons & war crimes.
In your reply to that communication, you suggests you are unsure of the points I made with regard to war crimes, Tony Blair and duty of care & responsibility, so I reply in an attempt to clarify these point for you, and hopefully make it clear what I understand to be your duty of care & responsibility, to not just your constituents but the wider public in your role as an MP, a role which it is my belief, provides you with a good salary and expenses, from the public coffers into which tax payers contribute.
Firstly, let me explain, my academic background is within the social care sector, where I studied Health & Social Welfare, Social policy & latterly European social policy, at Degree level, although I received my FDA for my 1st two years, I was unable to complete my final year at BA level due to health issue which affected my ability to attend university & complete my Studies.
None the less I have a sound knowledge of the subject & the acts of law & policies procedures relevant.
So, let me first address the point you say you don't understand regarding Duty of care & responsibility, and be clear about the point I was making.
Duty of care is paramount in the role of social health & welfare.
In your role as an MP, you play a fundamental role in insuring the policies and procedures of social policy & government are in the best interest of the public, your constituents & indeed the wider public as a whole.
Politics, are of course, the activities associated with the governance of a country or area, and as such are concerned with a whole range of sectors, all relate to social health & social care which include,
1. Personal Care & Protection from risk of harm or danger, including mental health issues,
2. Social Care , which includes, housing, front-line services, community resources, employment , defense & of course financial, & care of the economy... to mention but a few, for example a "health nation is a wealth nations"...
So, the point I was making Mr Donohoe, is that, as a MP you have a duty of care & responsibility to the public to insure that the health & social care policies, and procedures of government, are in the best interest of the people & ecconomic good of the nation. Whither that be as a member of the party leading government, or in opposition.
Additionally, in your role as a representative of the people who have, or have not voted for you personally,
you have a duty & responsibility to insure that legal presidencies, and acts of legislation are adhered to, and not just nationally but internationally, indeed, as a representative of the people who voted for you, your responsibility, in that context is to act impartially, irrespective of personal or party loyalties.
You have duty is to insure that the law is upheld & does not pose threat or risk to the public, nationally or internationally, that Mr Donohoe,is your duty as a public servant and representative of the people, in a social care context.
Which is what being an MP means, you work for, and are paid, by us, the people of the nation, & your duty is to our Social health & welfare needs & the health of the nations economy, & that includes protection from corruption in government, or by government leaders, what ever party, or whoever they may be.
Frankly Mr Donohoe, I find it rather alarming that you asked the question "Where does a “duty of care” apply in relation to Members of Parliament?" you should know the answer to that , you have a duty to know the answer to that.
Now to your next point of query regrading war crimes & Tony Blair.
You state in your reply "it is not the role of Members of Parliament to initiate criminal charges." I disagree.
It is the responsibility of any citizens to report and initiate legal action if there is suspicion or evidance to suggest a crime has been committed.
Good god , Mr Donohoe, where is your sense of ethic and moral compass?
The whole rhetoric around which last weeks paramilitary vote regarding Syria, was based on the allegations that Assad had committed war crimes by using chemical weapons on his own people, & thus committed crimes against humanity.
Right now, the president of the USA is hell bent on starting world war 3 on these very allegations related to the use of chemical weapon & crimes against humanity, to date unproven allegations.
These are almost identical allegations that were made against Sadam Hussian, and were given as the reaon Tony Blair took the UK into the Iraq war, which saw an estimated 157,531 civilian deaths, & 4,802 US & Coalition military killed between 2003–2011, http://www.theguardian.com/news/datablog/2012/jan/03/iraq-body-count-report-data
& that does not include those injured or displaced or who will suffer ongoing trauma (PST) as a result of that war, and you have the impertinence to ask me about the role of “duty of care” applicable in relation to Members of Parliament, & suggest

Your role Mr Donohoe is one of public servant , as I have already stated,
your role Mr Donohoe is to protect the needs & welfare priorities of the people, nationally & internationally,
your role is to hold accountable those who seek to harm, or who have caused harm to the masses,
That is your duty, that is what you are paid for by the people, and that is what should come above any personal or party loyalty you have.
You have a duty to act in the best interest of the people in regard of all social & health issues, and you have a duty to do so irrespective of your own political ideology, including bringing to justice those from your own party who are subject of suspicion and allegation of mal practice in office, or of committing war crimes and crimes against humanity.

Granted, this may not have been an officially recognized international court room or tribunal, however those involved were people with recognized credentials & academics, and additionally they are not alone in these allegations, there have been many like them who have made testament, that Blair is indeed a war criminal & should be persuade accordingly for his crimes.
Furthermore, I find your comment that states "Tony Blair is no longer in Government" all but insulting.
Tony Blair may not be in government, however he still has an influential role in government as Middle East peace envoy for the UN, US, EU and Russia, and has great influance on decision making & as a lobbyist as has been reflected by Mr Cameron who said Mr Blair "does lobby me from time to time on things like the Middle East peace process"

you are probably aware Parliament was recalled last Thursday to discuss
chemical weapons being used in Syria. The Prime Minister was proposing
that the
UK should take part in military action because of the use of chemical
weapons, with the US and other western allies, against the Assad
government in Syria. I voted against this proposal, because I did not
see how the proposed action could be effective, and
it was not clear what the ultimate goal was.
I am opposed to the use of chemical weapons, as we have previously discussed.
You
raise the issue of pursuing a charge against Tony Blair under the
general heading of “war crimes”, but it is not the role of Members of
Parliament to
initiate criminal charges. If there are people who have witnessed, or
have evidence that a crime has been committed, it is up to them to make a
complaint.

in this context, but I do not understand how that would work. Where does

An Open Letter to Stephen Fry Chairman MIND
Dear Mr Fry,
I write to you as someone who has long admired your work with people with mental health issues, and all that you have done, and continue to do to raise awareness in regard of the serious issue people with mental health issues are faced with.
I also have great admiration for you stance speaking out against those who use religion as a tool of hatred, discrimination and war, and of course all your work as a gay rights activist, I am, without fear of contradiction one of your admirers, a fan.
However the purpose of this letter is not to sing your praises, or heep compliments on you, but to ask for your help with a matter of great concern to me, and I want you to know I make this request not out of malice or hatred but out of deep, deep concern for both the British people & indeed the people of the world.
I like many people have watched, sometimes with bewilderment , the actions & behaviors of our current prime minister, and his political leaning apart, I have grave concern regarding his metal stability.
I do not say this as a joke, or even as a lay person, because although I am neither physician or psychiatrist, I have considerable experience and knowledge regarding mental health issues, as both patient, practitioner with people with MH problems, and as former undergraduate of Health and social welfare & social policy, during which time I studied & familiarized myself with the various acts of law related to health & welfare, policy & procedure, and in particular those related to mental health.
Indeed Mental Health was the subject of choice I based much of my university course work around as it was the career path I intended to follow.
Over the last 4 years I have observed with interest & ofttimes concern, the behavior patterns & actions of Mr Cameron, I have looked closely at his body language, his facial expression , I have listened carefully to his speeches, his debates & his interviews and taken note of his tone & language,& on occasions when he caught of guard , his reactions, and I strongly believe he has serious mental health issues.
In fact I would go as far as saying he is criminally insane, and most defiantly projects behaviors that are normally used in diagnosis of pathological behaviors.
As an ordinary member of the community , this could be a problem if undiagnosed and untreated, as a Prime Minister, this is a serious problem, that poses risk to not just the nation, but the international community, and something has got to be done to stop these risks to society.
Under the provisions of the Mental health act 1983 section 2 article 2b it states;
(2)An application for admission for assessment may be made in respect of a patient on the grounds that—
(a)he is suffering from mental disorder of a nature or degree which warrants the detention of the patient in a hospital for assessment (or for assessment followed by medical treatment) for at least a limited period; and
(b)he ought to be so detained in the interests of his own health or safety or with a view to the protection of other persons.
I believe under this provision on the basis of the facts I have already stated and indeed (b) with a view to the protection of other persons. that we have a moral duty to the people of this county & the world to have Mr Cameron detained in a metal health establishment in order that assessment and diagnosis to ascertain the level of his competence as prime minister, and indeed, not with standing the good of his mental health should he need treatment , which I strongly suspect he does.
As an ordinary citizen I have neither the power or the influance to make demands that David Cameron undergoes mental health assessment.
You, on the other hand , do have influance, and I am sure you have many contacts with professional credentials who could at very least verify if I have grounds for my concerns, and if they agree, could use their influance to have him undergo assessment , even if that has to be under medical section (F3)
F3(3)An application for admission for treatment shall be founded on the written recommendations in the prescribed form of two registered medical practitioners, including in each case a statement that in the opinion of the practitioner the conditions set out in subsection (2) above are complied with; and each such recommendation shall include—
(a)such particulars as may be prescribed of the grounds for that opinion so far as it relates to the conditions set out in paragraphs (a) and [F4(d)]F4 of that subsection; and
(b)a statement of the reasons for that opinion so far as it relates to the conditions set out in paragraph (c) of that subsection, specifying whether other methods of dealing with the patient are available and, if so, why they are not appropriate.
I am fully aware of the seriousness of what I have said , and believe me I make this plea to you to help me in all seriousness, this is not a joke, I truly believe there is serious cause for concern, and justifiable cause for assessment, at very least.
Mr Cameron poses a serious risk to the health and safety of others and surly this indicates a duty of care for the protection of other persons that gives justification for mental health assessment, not just on the grounds of his political behaviors which are obvious, but on the grounds of his personal behaviors that indicate he is quite probably psychotic & possibly pathologically.
So, Mr Fry, in conclusion I urge you to do what is necessary by using the influance you have as chairman of MIND & in your other capacities & get the necessary collaboration from your associates in the phyciatric & medical professions in order to insure that Mr Cameron undergoes psychiatric assessment and diagnosis and if necessary the treatment to manage his mental health illness.

latest corrispondance sent to MP today regarding chemical weapons, war crimes war criminals & accountability
Mr Donohoe,
Thank you for you speedy reply regarding the chemical weapons issue, I trust you will be as vigilant at keeping me up to date on how this progresses as you were regarding the issues we communicated on regarding the Stuart Hall case.
Now, I am sure you are aware of my position on the very serious issue regarding chemical weapons, indeed I would imagine you may have some inclination as to my position as a constituent, on the whole issue of war, and indeed, transparency regarding the behaviors of government & accountability of government.
I am, of course aware, that we have many different opinions on the issues involved in this regard.
For instance I am aware that you voted moderately in favor of the Iraq war, and strongly against investigation into that war,
and of course this is cause for concern for me, coupled with your voting strongly against transparent government.
However you have a duty of office to represent people like me, your constituents, and therefore I feel it is relevant that I, as one of those constituents make you aware of my wishes as to how I wish my views to be represented.
In recent months, indeed over the last 4 years , it has become clear though various reports & disclosures via leaks, that the public were kept very much in the dark regarding the Iraq & Afghan wars, not least via the Afghan war logs & Iraq war logs disclosed and exposed by Bradly Manning,and although I understand these revelations, leaks , may not sit well with you personally in light of how your votes in regard of the Iraq war, & indeed, tranparancy in government reflects, I believe your duty is to represent constituents, and this should take precedence over your personal position on these issues.
With this in mind, I feel it is particularly important now, with these latest revelations regarding chemical weapons & chemical compounds used to produce these weapons being sold to unstable governments with poor human rights records by British companies with licenses granted by Vince Cables office, that the government is held accountable and the public is made aware clearly, as to what government has been doing in the name of the people.
It is clear that chemical weapons are regarded as weapons of mass destruction, indeed it was on the basis of this that Tony Blair took the UK into the Iraq war, and given what we now know about the UK governments behavior & indeed Mr Blair's position on that war as a result of the Chilcot Inquiry, I feel very strongly that there are still many question to be answered in regard of these issues , particularly in light of the latest discloser regarding the chemicals involved being licensed by sale by the UK government to UK based companies & it beggars the question as to were these same companies involved in selling weapons to Iraq, because it stands to reason to believe that if companies were granted these license's in 2011 then there is a strong possibility they were also being granted these licenses during the Iraq war, despite these weapons being banned by international treaties & indeed, the whole basis around which the rhetoric promoting the Iraq war was "sold " to the public.
I like many other people in the UK, & indeed the rest of the world, believe Tony Blair has been shown to have behaved not only wrongly, immorally & unethically in regard of the Iraq war, but criminally, and I believe parliament has a duty to hold him accountable with regard to criminal activities & behaviors with regard to Iraq & Afghanistan wars.
I don't believe the Chilcot inquiry did this, although it did provide substantial evidance to support that Mr Blair's behaviors & indeed evidance was unreliable.
I believe MP's have a duty to the nation to hold accountable mal practice & criminal practice by members of government, and that this duty should take priority over any party loyalty to individual leaders or indeed party policy.
In the case of war crimes & chemical weapons the safety, protection & rights of civilians, of the people is paramount, and those involved in violating these fundamental rights & safety must be held accountable no matter what position they have held in government , as is reflected in the fact that the International Criminal Court, in the Hague exists to hold those who commit crimes against humanity accountable.
With this in mind, I now urge you to take the appropriate steps to insure accountability & transparency from government regarding these licenses pertaining to chemical weapons & compounds used to produce them & their sales abroad, and I further urge you to insure that this investigation includes looking back over the granting of these licenses, during and under Tony Blairs leadership, because it is & was every bit a dangerous, irresponsible & unethical to have been granting these licenses then, via the defense department, as it is now, particularly given the pretext that the UK, under the leadership of Blair went to war in Iraq because Blair was insistent that Sudam Hussian had chemical weapons and planned to use them on his people. One has to asked was Mr Blair so hell bent and insistent because he was aware that UK had granted the lisence for the sale of these weapons.
There has been way to many lies & deceptions in recent years by governments, including the former labor government, regarding issues of war & war crimes, that have caused way to many losses of life both to civilians of the countries were the UK, with its allies have intervened, and indeed causeing loss to British troops & their families in addition to the thousands who have been injured & displaced.
It is time for individual MP's like yourself, who represent the people of the UK, to do the correct thing by their constituents instead of giving lip service in order to gain votes,
it is time for individual MP's to hold government accountable for the lies cover-ups and deceptions they have inflicted on the people they are meant to represent over the last 3 decades,
It is time for MP's to level with the public and hold criminals in government involved in unethical behaviors & war crimes accountable,
With this in mind,I again urge you to insure that those involved with these latest chemical weapons revelations are held accountable & made face criminal proceedings,( the sale of chemical weapon is I believe illegal under international law)

Thank you for you speedy reply regarding the chemical weapons issue, I trust you will be as vigilant at keeping me up to date on how this progresses as you were regarding the issues we communicated on regarding the Stuart Hall case.
Now, I am sure you are aware of my position on the very serious issue regarding chemical weapons, indeed I would imagine you may have some inclination as to my position as a constituent, on the whole issue of war, and indeed, transparency regarding the behaviors of government & accountability of government.
I am, of course aware, that we have many different opinions on the issues involved in this regard.
For instance I am aware that you voted moderately in favor of the Iraq war, and strongly against investigation into that war,
and of course this is cause for concern for me, coupled with your voting strongly against transparent government.
However you have a duty of office to represent people like me, your constituents, and therefore I feel it is relevant that I, as one of those constituents make you aware of my wishes as to how I wish my views to be represented.

The
death of hundreds of Syrian civilians from a suspected chemical weapons
attack last week is abhorrent and cannot be ignored. The attacks were a
moral outrage and the use of chemical weapons
rightly demands condemnation by the international community.
While Labour condemns the attacks and the on-going violence in Syria, the
decision to use military force is a grave
one, and one that must be made in the right way. That is why Ed Miliband
moved an amendment to set out a clear and legitimate roadmap to a
decision on military action. Labour’s amendment would
have required any action to have a clear legal basis in international
law, clear and achievable military objectives, and to be limited to
deterring the future use of chemical weapons. We are determined to avoid
the mistakes that were made with Iraq over ten
years ago.
Members
of Parliament on both sides of the House voted to prevent David Cameron
rushing into a military conflict when so many questions remain
unanswered. In response, the Government
have announced that Britain will not be involved in any military action
in Syria. But we will not let the Government wash its hands of the
issue - there are other diplomatic and humanitarian means to help the
people of Syria and the Government must use the
G20 next week to galvanise international support to push forward a
political settlement to the conflict in Syria.

I am sure by now you will be aware of my deep various concerns with regard to the present government
& their behavior since taking power.
So I am sure it will come as no shock that I have particular concerns about their policies regarding the sales of weapons, at a time when so many people, in so many places, are falling victim of these weapons our government is selling, to often, unstable regimes & countries with very poor human rights records.
I have today read in the papers that Vince Cables office , The Department for Business, Innovation and Skills, granted licenses in January 2012, to unnamed companies 10 months after the Syrian uprising began, at a time when we had seen David Cameron brokering arms deal in Saudi Arabia & Qatar, nations who have much to gain from war in Syria the wider region, and who are said to be backing some very extremist groups involved with the rebel factions, on top of which we have heard, stories & seen reports from many internet sources & film recordings of some extremely beastly behaviors by some of these extremist rebels as scribed by George Galloway in his recent house of commons speech.
Once I again I urge you to take the correct steps within your duty to your constituents, & the people of the UK to hold cabinet & indeed all of those accountable as to why & how, these negligent behaviors happened, and make request that you will add your voice & support to those of Dunfermline and West Fife Labour MP Thomas Docherty , plans to lodge Parliamentary questions tomorrow and write to Cable, & The SNP’s leader at Westminster, Angus Robertson MP, who is reported to have said: he will be raising this in Parliament as soon as possible to find out what examination the UK Government made of where these chemicals were going and what they were to be used for.
I think it is important that there is cross party support for any MP who is taking the bold steps to actually challenge & demand answers from this government on behalf of the people of this country who they represent.

this I believe, Mr Donahue ,is a very dangerous sign in a governments behavoir , nor is it in the best interest of the people, both at home & abroad.
